Under Texas Penal Code §31.04, a debtor's unwillingness to pay a bill can be prosecuted as theft if certain conditions are met such as "they fail to make a payment after receiving notice demanding payment". Specifically, the Courts may presume that a debtor failed to make payment under a service agreement within ten days after receiving a notice demanding payment.
The criminal penalties for theft of services can range from Class C misdemeanors to first-degree felonies punishable by a prison sentence from five to 99 years. In addition to fines and jail time, a criminal conviction for theft of services can have outside consequences impacting employment, education, and housing.
